5. Limitation of Liability

IN NO EVENT SHALL LENNEX TEMPORARY FENCE RENTALS & SALES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF LENNEX TEMPORARY FENCE RENTALS & SALES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SITE.

6. Indemnification

You agree to indemnify, defend, and hold harmless Lennex Temporary Fence Rentals & Sales and its affiliates, officers, agents, employees, and licensors from and against any claims, liabilities, damages, judgments, awards, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or violation of these Terms and Conditions.

7. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed by the laws of the Province of Ontario, Canada. Any dispute arising out of or in connection with these Terms and Conditions shall be resolved exclusively in the courts of Ontario.

8. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision shall be deemed severed from the remaining terms and conditions, which shall continue to be in full force and effect.

9. Changes to These Terms and Conditions

Lennex Temporary Fence Rentals & Sales reserves the right to modify or update these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site after such changes constitutes your acceptance of the modified Terms and Conditions.
